Ministerial duties

Immunity is removed under ministerial acts

Municipalities in NJ have the duty to comply with Court Rulings and Orders. These ministerial duties MUST be followed. NJ Municipalities and their employees are required to follow Ordinance Laws. These ALL are ministerial duties to comply with. Failing to comply with ministerial duties are clear violations for liability, NJ Municipalities are NOT immune from. Violating a Court's Order is CONTEMPT OF COURT!


NJ Municipalities are also required to inform their Insurer of lawsuits filed as stated in the 9/14/2004 Insurance Claim Acknowledgement. 


If a NJ Municipality makes a representation to a Superior Court "on record". The Municipality MUST show that they stood on that representation as the word "DIRECTED" becomes a ministerial duty for others to follow. Otherwise, this could lead to FRAUD ON THE COURT, with other actions that were created from the word "DIRECTED". There is no time limit to bring forth a claim for FRAUD UPON THE COURT.


Court Records show that the city of Asbury Park NJ represented to the Court that they directed Police Director Louis Jordan to cease exercising police powers until the final resolution... The Final resolution was the Court order PROHIBITING Mr Jordan from exercising police powers. The Appellate Division upheld the Court Order.


The New Jersey Tort Claims Act (TCA), a "ministerial act" refers to a duty performed by a public official or employee that is mandatory, non-discretionary, and often involves following a clear, prescribed procedure. Unlike discretionary acts which involve personal judgment and are generally protected by immunity, ministerial acts can remove immunity, making the government liable for harm resulting from their negligent performance. 


  • Ministerial Acts: These are acts where the official has little or no discretion; they are bound to perform a duty in a prescribed manner.
  • Discretionary Acts: These acts require an official to exercise their judgment or discretion, and they are typically protected from liability under the TCA. 


Impact of Ministerial Acts on Government Liability

  • When a public entity's employee performs a ministerial act in a negligent manner, the immunity provided by the TCA is removed, allowing for a potential lawsuit.
  • This exception to sovereign immunity ensures that the government can be held accountable for failures in the performance of specific, mandated duties that result in harm to an individual, as outlined by the NJ Courts.
